The Medicare and Medi-Cal Maze - Elder Care Attorney Los ...

As a Certified Elder Law Attorney I have had to learn about Medicare, Medi-Cal and since my certification is from the National Elder Law Foundation Medicaid (which is the national version of Medi-Cal.) There is so much misinformation out there. Most of the calls I receive come from families who have just found out that their loved one is not going to be able to come home, their loved one needs to stay in the ?Rehab? or Skilled Nursing Facility, but that Medicare is no longer going to pay and they need to pay for the care. Families are shocked! Most families believe they have coverage for 100 days and although that can be true if your loved one does not need a medical service such as physical therapy, speech therapy, dialysis, etc. then Medicare will not pay because the care is custodial.
What is a family to do? Skilled Nursing Facilities cost $7000 to $12,000 a month (or more). Privately paying will deplete all the assets quickly. If someone is receiving Veteran?s Benefits, the amount does not increase as the cost increases, and since the rules for Veteran?s Benefits are different than the rules for Medi-Cal, the annuities purchased or gifts made could disqualify a person from receiving help from Medi-Cal.
There are Three common myths about Medi-Cal coverage of Skilled Care.
1. I will be on Welfare. Medi-Cal for skilled care is NOT welfare, unlike the program to cover healthcare in the community for the poor the program for Skilled Care is designed to help the ?middle class? when Medicare no longer pays.
2. I/We have too much money. With proper planning which is both legal and moral I can preserve your assets and help obtain Medi-Cal assistance to pay for care in a Skilled Facility.
3. The State will take your home. The state can not take your home if you intend to return or if your spouse lives in your home. If you fail to protect your home the State will have the right to recover the funds it pays for your care.
